Illegitimate service dogs impact businesses, legitimate service dog handlers, and the integrity of the Americans with Disabilities Act (ADA). At Justice Speaks, we believe in protecting the rights of individuals with disabilities and shutting down those who undermine those rights. We will explore how businesses can address this issue while complying with the law.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">The Rights of Businesses: Questions That Can Legally Be Asked of Service Dog Handlers\u00a0\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400\">Businesses are often unsure of how to navigate the presence of service animals and can understandably choose to refrain from intervening due to fear of breaking the law. The ADA allows businesses to ask two specific questions to determine whether a service dog is legitimate or not:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u201cIs the dog a service animal required because of a disability?\u201d<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u201cWhat work or task has the dog been trained to perform?\u201d<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400\">To protect handlers&#8217; rights, businesses are not allowed to ask about an individual\u2019s disability, require medical documentation, demand a demonstration of the dog\u2019s tasks, or ask for the dog&#8217;s identification papers.
