We will cover laws surrounding public access rights, housing protections, and violation penalties.<\/span><\/p>\n<h2><b>What is Considered a Service Dog Under Florida Law?<\/b><\/h2>\n<p><span style=\"font-weight: 400\">In Florida, a Service Dog is defined as \u201ca dog trained to perform tasks that mitigate the effects of a person\u2019s disability.\u201d These disabilities can include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><b>Physical<\/b><span style=\"font-weight: 400\"> &#8211; retrieving dropped items, opening doors, providing stability, operating light switches, and alerting caregivers in emergencies.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Sensory<\/b><span style=\"font-weight: 400\"> &#8211; visual and hearing impairments, providing support to help reduce sensory overwhelm.<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/justice-speaks.org\/the-role-of-a-psychiatric-service-dog\/\"><b>Psychiatric<\/b><\/a><span style=\"font-weight: 400\"> &#8211; post-traumatic stress disorder (PTSD), anxiety, depression, obsessive-compulsive disorder (OCD).<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Neurological<\/b><span style=\"font-weight: 400\"> &#8211; Epilepsy, migraine disorders, Parkinson\u2019s disease.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Intellectual<\/b><span style=\"font-weight: 400\"> &#8211; down syndrome, cognitive delays, developmental disorders.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Emotional support animals (ESAs) are not considered service animals under the Americans with Disabilities Act or Florida law. ESAs are not trained to perform specific tasks related to a particular disability and, therefore, fall outside the definition of a service dog.<\/span><\/p>\n<h2><b>Public Access Rights<\/b><\/h2>\n<p><span style=\"font-weight: 400\">Service dogs are allowed <\/span><a href=\"https:\/\/justice-speaks.org\/how-to-advocate-for-service-dog-accessibility-in-public-spaces-in-2025\/\"><span style=\"font-weight: 400\">public access rights<\/span><\/a><span style=\"font-weight: 400\"> under federal and Florida state laws. Businesses are permitted to ask the following two questions to service dog handlers:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u201cIs this service dog required because of a disability?\u201d<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u201cWhat task has the dog been trained to perform?\u201d<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400\">Business owners are <\/span><b>not<\/b><span style=\"font-weight: 400\"> legally allowed to ask about the handler\u2019s disability or request proof of the dog\u2019s certifications or training.<\/span><\/p>\n<h3><strong>Dog Behavior Expectations<\/strong><\/h3>\n<p><span style=\"font-weight: 400\">Service dogs are expected to be under the control of their handler at all times, preferably on a leash or harness, unless this impedes their ability to perform their duties. Finally, landlords must make reasonable accommodations for those with service dogs unless it would create an undue financial burden.<\/span><\/p>\n<h2><b>Penalties for Service Dog Violations<\/b><\/h2>\n<p><span style=\"font-weight: 400\">Federal and Florida state laws protect the rights of service dog handlers by enforcing penalties on those who discriminate or interfere with handlers.<\/span><\/p>\n<h2><b>Penalties for Interference with or Injury to a Service Animal<\/b><\/h2>\n<p><span style=\"font-weight: 400\">Florida criminal law has penalties for individuals and businesses convicted of interference with or injury to a service animal. <\/span><a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?mode=View%20Statutes&amp;SubMenu=1&amp;App_mode=Display_Statute&amp;Search_String=service+animals&amp;URL=0400-0499\/0413\/Sections\/0413.081.html\"><span style=\"font-weight: 400\">Florida statute 413.081<\/span><\/a><span style=\"font-weight: 400\"> covers:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A person who interferes with (or permits their dog to interfere with) a service animal by obstructing, intimidating, or jeopardizing the safety of the service animal.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A person who recklessly or intentionally injures or kills (or permits their dog to hurt or kill) a service animal.<\/span><\/li>\n<\/ul>\n<h4><span style=\"font-weight: 400\">Restitution for these crimes includes:<\/span><\/h4>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the value of the service animal<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">replacement and training or retraining expenses for the service animal and the user<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">veterinary and other medical and boarding expenses for the service animal<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">medical expenses for the user<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">lost wages or income incurred by the user during any period that the user is without the services of the service animal<\/span><\/li>\n<\/ul>\n<h2><b>\u00a0Penalties for Misrepresentation of a Service Dog (Fake Service Dogs)<\/b><\/h2>\n<p><span style=\"font-weight: 400\">Florida service dog laws also hold individuals liable for fake service dogs. Individuals who misrepresent their pet as a service dog can face:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Fines up to $500<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">30 hours of community service for an organization serving individuals with disabilities<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">The United States has extensive federal laws to protect service dog handlers and their dogs.
